The Cardano Foundation has asked the European Union to keep decentralized finance (DeFi) and staking out of expanded licensing rules under the MiCA framework. In its response to the EU’s MiCA review, the Foundation argues that non-custodial, protocol-level participation is not a financial service and should not be regulated like one.

The consultation closed on . What the European Commission does with the responses will shape the regulatory picture for digital assets through 2027, and could lead to legislative proposals.

Custody Is the Dividing Line

The Foundation’s case rests on one distinction: direct participation in a network versus providing an intermediary service. Under its reading, duties should scale with how much control an operator has over customer assets. A business that holds or controls tokens for customers looks like an exchange or custodian. A user who delegates stake on Cardano and keeps full custody of their tokens does not.

The Foundation also opposes building separate regulatory frameworks for DeFi and staking, and wants the Commission to clarify how MiCA applies to them before any such frameworks take shape. It warns that licensing requirements aimed at protocol-level activity would raise compliance costs, limit market access for Cardano users and developers across Europe, and could push innovation outside the EU.

Staking is not the only item on its list. The Foundation is also asking for clearer rules on cross-border token ownership, stablecoins, and unique NFTs.

A 2027 Report and a Wider Push for Binding Rules

The Commission’s full MiCA report is due by , and other EU bodies are separately discussing oversight of crypto lending. The outcome could set a reference point well beyond Europe for how crypto oversight treats staking and DeFi.

Cardano is not alone in pressing for firmer ground. Chainlink, Hedera, Stellar, Aptos, and Avalanche have jointly asked the U.S. SEC to codify its digital commodity framework, seeking binding regulation instead of explanatory guidance. On the market side, ADA traded at Rp4,107 on Pluang, up 2.78% over 24 hours, with a market capitalization of Rp151.47 trillion and 24-hour volume of Rp5.16 trillion. Order activity was balanced, a steady picture despite the regulatory debate.

Hashlytics Take

The headline ask is exemption, but the argument underneath is a control test, and a control test cuts both ways. It protects Cardano’s delegation model, where users never hand over custody. It also leaves any protocol with real admin keys or upgrade powers squarely in the frame. The Foundation is betting that Cardano sits comfortably on the right side of that line, and that regulators will accept control as the measure rather than the word “decentralized.” Notably, both the EU consultation and the SEC letter share the same underlying demand: rules written down in binding form, so that builders know where the line is before they build.
