Democrats are projected to hold at least 225 seats and could reach 244, against the 218 needed for a majority. The Senate count is still open at 46 to 38, with Democrats flipping North Carolina and South Carolina. New laws will be much harder to pass from here, although President Trump keeps his executive powers.
The CLARITY Act Has Until January 3
The CLARITY Act, a bipartisan crypto bill, failed in the Senate 49 to 50 in September. All 49 “yes” votes came from Republicans, The Defiant reported. The bill expires on January 3 if the Senate does nothing.
After that, any new version would have to clear a committee likely chaired by Maxine Waters, one of the crypto industry’s most prominent critics. Senator Angela Alsobrooks, a negotiator on the bill, still sees a deal as possible.
The lame-duck session running until January 3 is the last window for the CLARITY Act in its present form.
Waters Brings Subpoena Power, Not Just a Veto
Waters is poised to chair the House Financial Services Committee, which gives Democrats hearings, subpoenas, and a say in what reaches the floor. TD Cowen’s Washington analyst Jaret Seiberg expects investigations into President Trump’s crypto business ties under her leadership.
Markets moved against risk after the call, though not obviously because of crypto:
| Market | 00:35 CET | After the House call | Change |
|---|---|---|---|
| Bitcoin | $77,877 | $75,846 | -2.6% |
| S&P 500 futures | 7,624.50 | 7,500.75 | -1.6% |
| Brent crude | $104.33 | $102.84 | -1.4% |
| Gold | $3,941.5 | $3,944.3 | +0.1% |
Nasdaq 100 futures also dropped about 2 percent. Investors appear more worried about tighter rules for data centers and AI infrastructure than about crypto itself, and betting markets on Polymarket showed odds of a Democratic sweep climbing sharply before the official call.
What Is Still Undecided
Senate races in Texas, Kansas, and Ohio remain open, and Alaska’s results are still pending. A closely watched US jobs report is due Friday, , the next data point for interest rate expectations. The new Congress convenes in January to elect a Speaker.
Hashlytics Take
The CLARITY Act is the visible casualty, but oversight is the bigger shift for crypto. A Waters-led committee does not need to pass anything to matter. Hearings and subpoenas on Trump-linked crypto ventures can shape how lawmakers and the public talk about the whole industry, and they can do it every month for two years. Bitcoin’s 2.6 percent drop, only a point or so worse than the S&P 500 futures, reads more like broad risk-off than a crypto-specific verdict. The real test comes if a Senate deal stalls before January 3. At that point the market has to price a rewritten bill drafted under a hostile chair instead of the one it already knew.
