Kraken co-CEO David Ripley has publicly criticized the United States’ approach to cryptocurrency regulation, calling the current environment hostile and contrasting it sharply with Europe’s more pragmatic path for digital assets.

A Stalled Bill and a Growing Frustration

The U.S. has struggled to pass a comprehensive digital assets bill, and the failure of the CLARITY Act left a significant regulatory void. Ripley’s comments reflect a frustration that has been building among industry leaders for years, not a one-off complaint.

He finds it fascinating that the U.S. maintains its financial services leadership despite the stalled legislation, noting that many credit that leadership to being forward with innovation and regulating products early rather than reactively.

Why Ripley Points to MiCA

Ripley praised Europe’s Markets in Crypto Assets (MiCA) framework, which provides specific guidelines and was actually approved, unlike the stalled U.S. efforts.

In Europe, it’s more along the lines of ‘here’s this new technology, we’ve all got to figure out how to regulate it,’ because that’s what Europeans do, Ripley said in an interview with the Business Post. He described the U.S. tone by contrast as negative, belligerent, arguing that Europe’s more measured approach has fostered a healthier regulatory environment for the industry.

Kraken’s Own Move Into Europe

Kraken isn’t just commenting from the sidelines. The exchange secured a MiCA license from the Central Bank of Ireland in June 2025, a license that permits operation across all 30 member states of the European Economic Area.

That kind of single license covering dozens of markets is a meaningful contrast to the state-by-state, agency-by-agency patchwork exchanges still navigate in the U.S. It’s also a practical demonstration of where Kraken is choosing to plant its flag while U.S. rules remain unsettled.

Ripley’s comments arrive alongside another significant development. Kraken co-CEO Arjun Sethi recently confirmed the company has confidentially filed for an IPO with the SEC, a move that puts Kraken’s regulatory relationship with the U.S. under fresh scrutiny even as its leadership criticizes the current framework.

Ripley’s contrast is real, MiCA exists and CLARITY doesn’t, but it’s worth noting Kraken is simultaneously pursuing a U.S. IPO while its co-CEO publicly criticizes U.S. regulators. That’s not necessarily contradictory, companies routinely operate in jurisdictions they also lobby to change, but it does suggest the EU praise here is partly strategic positioning rather than a pure policy critique.
